The Delhi High Court on Thursday (December 12, 2024) refused to entertain a public interest litigation (PIL) raising allegations of sexual harassment in the ‘Indian film industry’.
A bench of Acting Chief Justice Bibu Bakr and Justice Tushar Rao Gedera said it could not order a “loitering and fishing” investigation unless there was a complaint from the aggrieved party.
Relying on the report of the Judicial Hema Commission on cases of sexual exploitation in the Malayalam film industry, petitioner Ajeesh Kalasil Gopi has urged the National Commission for Women (NCW) to requested directions to investigate alleged human rights and human rights violations. “Indian film industry” too.
“We will consider any complaints. Your petition is framed on the basis of the report of the Judicial Committee of Hema, which is being investigated by another court,” the court said. We will not order any fisheries surveys.”

The petition claimed that sexual harassment exists “throughout the film industry.” He also called for the commission’s report to be produced verbatim to ensure transparency.
However, the court said the complaint should have come from a survivor and noted that “the entire petition is based on speculation without substantive data.”
“The writ petition does not mention any specific complaint of sexual harassment by any particular person and there is no remedy for the same.In the given circumstances, we find it appropriate to follow the prayers of the petition. ” the court said while dismissing the petition.
