ISLAMABAD: An inflammatory petition was filed in prison at the ISLAMABAD High Court (IHC) created from the official X-account of Imran Khan, founder of Pakistan’s Tehrik e Insuf (PTI), Dawn reported.
The plea was raised by Citizen Gram Murtaza Khan through the defenders of Barista Zafarala Khan. He argued that the spread of “provocative and malicious” content from the accounts of convicted prisoners was illegal and violated prison rules.
Based on this argument, the petitioner urged the court to investigate who manages the founder accounts of PTI while he is in jail.
The petition also sought an order from social media platforms to block and delete such content. Dawn also called for instructions to the prison chief to prevent prisoners from accessing or operating social media, in order to call such activities “unconstitutional and illegal.”
Additionally, the petitioner asked the court to curb PTI from redistribution or promotion of posts that arise from the founder’s accounts while incarcerated. Contrary to this background, Imran Khan, founder of Tehreek e Insuf (PTI) in Pakistan, refused to cooperate with investigators from the National Cybercrime Investigation Agency (NCCIA) while visiting the Adiara prison, where he is currently in prison.
The report said that despite repeated attempts by the NCCIA to question the former prime minister regarding the “X” handle, authorities have consistently refused to meet them, making it impossible to obtain information.
Citing the source, Dawn said that a three-person NCCIA team led by additional director Ayaz Khan visited Central Prison Adiara for the second time this week to question the founder of PTI. However, Khan refused to participate in the investigation, saying to the team that he would “bring a lawyer if they wanted to ask him about any issue.”
The team arrived at Adiara Prison around 3:30pm and left nearly two hours later without progress in strict security. Dawn reported that the investigation was launched after a tweet critical of government officials and that the establishment was published from Khan’s account. Earlier in the week, the same team visited the prison to pursue the issue.
Separately, a petition has been filed with the Islamabad High Court (IHC). Imran Khan and his wife Bushira Vivi are seeking permission to exercise their marital rights while they are being held at Adiara Prison. The appeal was filed under Article 199 of the Constitution by Islamabad resident and supporter of Khan, Shahid Yakub, and appointed the Chief of Islamabad, the Punjab Government, the Punjab Prison Inspector of the prison and the Chief of Prison Adiara as respondents.
The petitioner argued that denying marital rights violated constitutional guarantees, international treaties and previous court decisions. The plea cited the UN Standard Minimum Regulations for the Treatment of Prisoners (Nelson Mandela’s Rules), the International Contract on Civil and Political Rights, and the European Convention on Human Rights.
The petition also mentioned a 2010 notice issued by the Sindh Ministry of Home Affairs following the directions of the Supreme Court. It also relied on the Federal Shariat Court decision that recognized the marital rights of prisoners as a fundamental qualification, urging the IHC to enforce both the SC and the federal Shariat Court’s directives.
